Today we had a spirited discussion about Georgia’s new noncompete employment statute – House Bill 30.  Our guests were State Representative Wendell Willard, one of the co-sponsors of the statute and William (Chip) Collins Jr, the attorney who heads Burr and Forman’s new noncompete and trade secrets group – he is also the editor of their new Noncompete & Trade Secrets blog.

Wendell Willard/ State Representative 49th District Georgia House of Representatives

Wendell is the co-sponsor of Georgia’s new noncompete employment statute that became effective last year and drastically changed the legal landscape for noncompetes.

State Representative Wendell Willard represents the 49th District in the Georgia House of Representatives. Since being first elected to serve in 2001, Representative Willard has been instrumental in passing several pieces of landmark legislation. Since 2005 Representative Willard has served as Chairman of the House Judiciary Committee.

Chairman Willard’s notable legislative accomplishments during his time with the General Assembly include: the 2006 passage of Georgia’s Eminent Domain law, which strengthened personal property rights for all Georgians, and the 2004 Child Protection Law, which protects children against reckless and abusive caregivers. Chairman Willard also points to the 2005 creation of the City of Sandy Springs, his hometown, by the General Assembly and the subsequent creation of the cities of Johns Creek and Milton among his most notable legislative accomplishments.

In recognition of his legislative accomplishments, Chairman Willard has been honored by: the Georgia Council on Aging with their Special Legislator Award, the Department of Human Resources with their Leadership Award, and by the Association County Commissioners of Georgia, among others. Most recently, he was honored in 2008 by the Georgia Municipal Association as a “Champion of Georgia’s Cities.”

Representative Willard resides in Sandy Springs with his wife Vicki. When not working at the Capitol, Representative Willard is an attorney in his own private practice, and serves as the City Attorney for Sandy Springs. Active in the Sandy Springs and North Fulton communities, Representative Willard serves on the board of The Newtown Park Foundation. Representative Willard serves as Chairman of the House Judiciary Committee and also serves on Appropriations, Ethics, Ex-Officio of Judiciary Non-Civil, and Vice Chairman of Rules. He was a member of the Insurance Committee from 2001-2005.

William (Chip) Collins, Jr.

Chip helps his clients successfully resolve multiple types of business disputes, including those involving breach of contract, commercial lending, unfair competition, real estate, and employment issues. He has represented clients ranging from individuals and small businesses to large banks and Fortune 500 companies in matters involving between tens of thousands to tens of millions of dollars in dispute. Chip firmly believes in working with his clients at the beginning of an engagement to clearly identify the client’s objectives and develop a strategy and budget for achieving the client’s goals in the most cost-effective manner. Although he is able to efficiently resolve most of his cases through dispositive motions or alternative dispute resolution, Chip is fully prepared to go to trial for his clients when necessary, having tried cases and handled appeals at both the State and Federal levels.

Disputes involving real estate and lending comprise a substantial portion of Chip’s practice. In the recent economic climate, Chip has spent the majority of his time representing several national and regional lenders in litigation involving large defaulted commercial loans, including the institution of receivership proceedings and defense of lender liability claims.

Chip has significant experience and expertise in helping businesses of all types prevent unfair competition through the drafting and enforcement of non-competition, non-disclosure, and non-recruitment covenants and the pursuit of remedies for misappropriation of trade secrets, breaches of fiduciary duties and other similar claims. He has written and lectured extensively on those subjects, as well. Chip has also successfully defended companies and individuals accused of unfair competition.

Chip is also often called upon to handle disputes arising from the break-up of business partners (the “business divorce”). In those cases, he attempts to temper the high emotions usually associated with such matters and work out a fair and common-sense resolution, thereby avoiding costly litigation that rarely provides a true economic “win” for any party in those types of cases.

Phillip Boykin is the Creative Director for Shark Branding, a New York based advertising and marketing firm founded by Daymond John, CEO of FUBU and one of the stars of the hit ABC entrepreneurial reality show, Shark Tank.

 

Antonia Newman / Team Fenom

Dissatisfied with the coverage of women’s sports, two sisters, Charlotte and Antonia Newman, founded Team Fenom, with a singular goal, to create the most recognizable brand in women’s sports.

Team Fenom is an online community connecting fans and a destination for women’s sports news and fitness information. They derived the name Fenom from combining female and phenomenal. Team Fenom is an expression of the global community of individuals who support women’s sports.

Antonia Newman is the co-founder and Chief Executive Officer of Team Fenom. She graduated with honors from Florida Southern College, earning a B.S. and MBA. Her athletic achievements include being a two-time Kodak/WBCA All-America honorable mention, holding school records in rebounds and blocked shots, and leading her team to four seasons of post-season play. Antonia also played professional basketball in Europe, served on the Euro-American Women’s Council Executive Global Advisory Board and was selected to develop a sports program to mentor Greek youth.  Antonia has over five years of sports management experience.

She worked in Basketball Development with the Atlanta Hawks and in Marketing and Fan Development with the Hawks & Thrashers. Given her devotion to athletics and passion for women’s sports, Antonia has volunteered her services with Florida Southern College’s women’s basketball program, the Atlanta Beat of Women’s Professional Soccer, the WNBA’s Atlanta Dream and the defunct Atlanta Glory of the American Basketball League (ABL).

 

Charlotte Newman / Team Fenom

CharlotteNewman is the co-founder and Chief Operating Officer of Team Fenom. She is an entrepreneur with a penchant for communication. Charlotte holds a B.A. from Wellesley College and graduated from Harvard Business School (HBS). She is fascinated by digital media and has started two blogs, one a summary of the best stories in tech and digital. At HBS, she co-wrote a case on ProPublica, the first online news organization to win the Pulitzer Prize. Charlotte’s interest in digital media grew from communications experience as an advisor to two U.S. Congressmen, Chris Murphy and David Scott.

As the co-founder of Team Fenom, Charlotte draws on extensive experience writing opinion editorials, speeches, and policy statements on Capitol Hill. She sits on the board of the Harvard Business School Club of Atlanta. In her spare time, Charlotte is an avid runner and huge sports fan. She formerly played basketball and ran track.

Leonardo McClarty/Dekalb Chamber of Commerce

Leonardo McClarty is the President/CEO of the Dekalb Chamber of Commerce . A career Economic and Business Development professional, McClarty is astute at dealing with various community, small business, and political challenges. His experiences include business recruitment, community redevelopment, planning, public policy analysis, and small business development. Responsible for the day to day operations of the DeKalb Chamber of Commerce, McClarty interacts daily with civic leaders, education professionals, business leaders, and elected officials to make sure that DeKalb County is the premier place to do business in Metro Atlanta.  Since his arrival in September 2004, this Atlanta native has more than doubled the DeKalb Chamber’s membership, increased its annual operating budget, and increased its status in the Atlanta business community.

Prior to taking the helm of the DeKalb Chamber, McClarty served as Economic Development Director for the City of Roswell and was a Senior Project Manager in DeKalb County’s Office of Economic Development. McClarty has also  worked for the Georgia Department of Community Affairs and Georgia Institute for Community Business Development.

McClarty holds a Master’s degree in City and Regional Planning from Clemson University and a Bachelor  of Arts degree in political science from Furman University. He is certified by the National Development Council as an Economic Development Finance Professional and has a certificate in non-profit management from the U.S. Chamber Institute for Organizational Management program. McClarty is the past Chairman of the United Way in DeKalb Campaign and sits on the Grady Health System Board of Visitors. He is also sits on the boards of the DeKalb Workforce Investment Board (WIB), DeKalb Convention & Visitors Bureau, Communities in Schools of Atlanta, CDC Federal Credit Union, and participates in various ad hoc committees and councils. He is a 2009 graduate of Leadership Atlanta and a 2008 graduate of Leadership DeKalb. In 2008, he was named one of Georgia Trend Magazine’s Top 40 under 40.

Mavian Arocha-Rowe/Strategy Magazine

Mavian Arocha-Rowe is the Editor-in-Chief at Strategy Magazine. She is also the Senior Editor at The Institute for HealthCare Consumerism, Senior Editor for Field Media, LLC, and a Freelance Writer/Editor and Spanish Educator.

Mavian promoted Strategy Magazine’s launch of an additional magazine that will be entirely in Spanish. It will be out this May and the cover will feature  CNN en Espanol’s fashion expert.

Dennis Zakas/Zakas & Leonard, Group Office Buys

Dennis Zakas is a partner with the law firm of Zakas & Leonard.  He focuses his law practice on mergers and acquisitions, securities offerings, corporate governance, joint ventures and complex commercial transactions. While most of his clients are in the technology and medical device industries, he has significant experience in telecommunications, pharmaceuticals, healthcare, manufacturing, distribution, transportation, logistics and real estate.  During his career, Zakas has played a major role in transactions exceeding $100 billion. His unique perspective results from representing a wide range of clients – from Fortune 50 to early stage – in a wide variety of industries, in a broad range of transactions. On many occasions Zakas has been listed in Best Lawyers in America, as well as a Mergers & Acquisitions Super Lawyer.

Zakas is also the Chair and CEO of Group Office Buys, LLC, an online provider of over 40,000 office supply, janitorial/sanitary and breakroom products and  is the primary inventor named in two patent applications covering a number of Internet business processes.

Dennis Zakas is a member of the Board of Directors of the Technology Association of Georgia (TAG).  In 2005  he was named TAG Volunteer of the Year for his role in founding and chairing the Georgia Technology Summit. He also founded TAG’s Top 40/10 Innovative Companies Award and continues to chair the Top 40/10 Committee. Additionally, Zakas writes the Technology Leadership blog for the Saporta Report, as well as is the Georgia Co-chair of the Society of International Business Fellows (SIBF).

When we think of movies, television and sports, we rarely think about the intense amount of data involved and the intricate systems required to access that data efficiently. Well, here at ShowBiz Atlanta, we’re all about digging beneath the surface to see what’s really going on.  To that end, we invited SGI to come in and chat about what they do!

SGI has a long history in the Media and Entertainment industry, from its early days of being the first platform to make possible the breakthrough 25 years ago for digital effects for such movies as Jurassic Park and Terminator, to today where SGI technology is used for managing the vast volumes of digital content generated by film, television and the gaming industry.

Mark Anderson, who works for SGI locally here in Atlanta along with Floyd Christofferson who called in from California, joined me recently to talk about how SGI provides the technology that is used for the digital mastering of virtually every major Hollywood film today.

They explained that SGI is used by such companies as Technicolor, Deluxe  and many others around the world. In addition, the same data storage management technologies that are used to manage the world’s weather data, enable advanced genome sequencing and to provide tactical support for US armed forces is also used to manage the massive digital content archives for companies like the NBA and National Geographic.

As a leader in technical computing, SGI remains at the forefront of big data management, and at the core of the entertainment industry’s ability to create and manage the extreme volumes of digital content that part of our daily lives.

The Friends of Gwinnett County Senior Services (Friends) is a nonprofit 501(c)(3) volunteer-run organization dedicated to raising funds to privately support or supplement select senior programs in Gwinnett County, Georgia. Gwinnett County has the second largest senior population in the state.  Past (Jennifer Thilo, Executive Director of Delmar Gardens), Present (Brad Culp, Owner of Griswold Special Care) and Future (John Winters, Founder of Cornerstone Financial Partners) Friends Board Presidents got together to discuss the upcoming 10th Annual Silent Auction, benefiting Gwinnett County Senior Services.

This year’s event is themed “Going for the Gold for Seniors”, and will be held next Thursday, April 26 from 6 pm to 8:30 pm at Delmar Gardens, 3100 Club Drive in Lawrenceville.  Tickets are $25 in advance, or $30 at the door.  There is still time to either sponsor the event, or donate an item for the auction.  To donate, please call (770) 923-3100.  We look forward to “world record-breaking” attendance at this gold medal event!

David Duley, the founder and CEO of I Can Media, LLC, is originally from Flint, Michigan but he has called Atlanta his home since arriving to attend school at Emory University’s Goizueta School of Business. He has since started and been apart of multiple entrepreneurial adventures. Some of those include The Handyman Network, Inc., Triad Ventures, LLC, and PEARL Protected.                                                                                                                                         

David’s latest project is I Can Media, LLC.  On December 31, 2011 the self published book titled “I Can Fix America : 52 common sense ways YOU can make the United States great again” arrived online and in bookstores across America.  David hopes his book I Can Fix America in conjunction with his website of the same name will help empower Americans with simple tool and ideas that can help restore America for generations to come. Since the release of the book, David has appeared on numerous national talk radio and TV shows.

David was appointed by City Council to serve on the Board of Ethics for the City of East Point, GA in 2009 and recently rolled off the Board of Directors for Jerusalem House in Atlanta Georgia which houses over 50% of permanent housing for the homeless living with HIV/AIDS in the Atlanta metropolitan area.  He is also a member of the board of directors for High Road Craft Ice Cream, one of the nation’s leading innovators in the ultra premium ice-cream market.

David is also co-owner of a successful restaurant in midtown Atlanta called The Nook, on Piedmont Park.  The Nook’s patio was ranked #2 by Creative Loafing magazine Atlanta.  In addition to a nice patio, The Nook has brought to market many innovative dishes that have reached acclaim such at Totchos™ (tater tot nachos) and the Shrimp and Grit Stuffed Burger, winner of the 2010 Atlanta battle of the burgers.
