Teresa Pike Tomlinson is a Partner in Hall Booth Smith’s Atlanta and Columbus, Georgia, offices, where she specializes in complex trial and appellate civil practice. She is known for her ability to handle strategically complicated and potentially high-value cases. She is admitted to courts throughout the country, including numerous federal circuit courts and the United States Supreme Court.

Teresa practiced law for 16 years with the plaintiff’s law firm of Pope McGlamry, where she specialized in complex litigation, giving her a unique perspective in her current defense cases. As plaintiff’s counsel, Teresa led a trial team to a $21.5 million award in her client’s favor, and led litigation teams in cases to include nationwide class actions, securities/derivative litigation, Real Estate Settlement Procedures Act Litigation, and Multi-District litigation.

As a young lawyer, Teresa prosecuted civil claims for surviving families of the 1996 ValuJet Air Crash, making her mark and becoming the first woman partner at her firm. She currently leads Hall Booth Smith’s multi-district efforts battling COVID-19-related claims in health care professional settings. Teresa previously served as Mayor of Columbus, Georgia, where she oversaw nearly 3,000 employees and a $275 million budget and was the chief elected official of the city/county government, public safety director, and Homeland Security Director for a 16-county region. She was a statewide candidate for the United States Senate in 2020, finishing second in a field of seven in the primary election.

Teresa earned a Juris Doctor from Emory University and a Bachelor of Arts in Government, Economics and Business Management from Sweet Briar College in Virginia. She served as Chair of the Board of Directors for Sweet Briar College, and in 2015 she led an initiative to raise $28.5 million in four months to avert a planned closure of her alma mater and put the college back on solid financial footing.

She is a member of the Georgia Bar and has been admitted to practice before federal and state courts across the country, including the United States Supreme Court, the Judicial Panel on Multidistrict Litigation, the U.S. Courts of Appeals for the Eighth and Eleventh Circuits, and the Georgia Supreme Court, among others.

Equal Pay Day and the Ongoing Quest for Pay Equity (Litigators Lounge, Episode 7)

On this episode of Litigators Lounge, hosts Jackie Voronov and Shylie Bannon examine the state of gender pay equity in recognition of Equal Pay Day. Their conversation begins by acknowledging the symbolism behind Equal Pay Day, representing how far into the new year women must work to earn what men did the previous year. Despite the existence of the Equal Pay Act passed over 60 years ago, progress toward closing the gender wage gap has been slow, with women earning on average 84 cents on the dollar compared to men, and even less for mothers and for women of color. Jackie and Shylie further explore how executive-level positions see a wider gender pay gap, contrary to common beliefs that higher education and positions would result in more equitable pay. They also discuss the impact of societal norms on women’s negotiation behaviors, the reluctance to discuss salaries openly, and conducting gender pay audits as a step toward addressing the wage gap. Jackie and Shylie urge listeners, especially women in influential positions, to advocate for equitable pay practices within their organizations.

“Because of Sex” – Looking Back at 60 Years of Gender Discrimination and Title VII (Litigators Lounge, Episode 6)

On this episode of Litigators Lounge, hosts Jackie Voronov and Shylie Bannon celebrate the start of Women’s History Month by discussing the history of Title VII of the Civil Rights Act of 1964. The hosts walk listeners through the events that led to the inclusion of gender discrimination as part of the law, the seeds of which sprang from a joke by an 80-year-old segregationist Congressman in debate on the floor of the U.S. House. Jackie and Shylie also touch on various landmark court cases, like Meritor Savings Bank v. Vinson and Price Waterhouse vs. Hopkins, which shaped the interpretation and enforcement of the law over time. They further discuss the evolution of gender and sex discrimination and review the Bostock case, including gender identity and sexual orientation finally recognized under Title VII. The hosts end the show by looking ahead to the next episode, which focuses on pay equity.

Employee or Independent Contractor: New Labor Department Guidelines, Jacqueline Voronov, Shylie Bannon, Hall Booth Smith

Employee or Independent Contractor?: Analyzing New Department of Labor Guidelines (Litigators Lounge, Episode 5)

On this edition of Litigators Lounge, hosts Shylie Bannon and Jackie Voronov discuss the recently announced final rule by the U.S. Department of Labor on the classification of a worker as either an employee or independent contractor under the Fair Labor Standards Act. The conversation explores the impact of the rule, which rescinds a Trump Administration regulation that made it easier for employers to categorize workers as independent contractors. Jackie and Shylie elaborate on the six-factor test to determine whether a worker is an independent contractor or an employee, touching on aspects like control over work performance, opportunity for profit and loss, and the nature of the work relationship. They also express views on the rule’s implications and advise employers to consult legal counsel to ensure compliance.

You can find the final Department of Labor rule on employee or independent contractor classification under the Fair Labor Standards Act by following this link. This rule goes into effect on March 11, 2024. For further commentary on the rule change and its implications from Hall Booth Smith partners Jackie Voronov and Jeffrey Daitz, follow this link.
