Brian Sengson/Bennett Thrasher

Brian Sengson is a Manager in the State and Local Tax practice with Bennett Thrasher. Brian specializes in helping clients reduce their effective state tax rates through multi-state tax planning, state credits, and economic development incentives. Brian also provides state tax consulting for M&A due diligence with an emphasis on income/franchise tax, sales and use tax, and unclaimed property.

Prior to joining the firm, Brian managed the tax litigation practice of a national consulting firm specializing in federal and state tax credits for small/medium sized businesses and Fortune 500 companies. Brian earned his Juris Doctorate with honors at Georgia State University and graduated from Lee University Magna Cum Laude with a Bachelor of Science degree, majoring in Business Management. Brian is a licensed attorney with the State Bar of Georgia, and is a member of the Bar’s Tax Law Section in addition to the American Bar Association (“ABA”).

Peter Stathopoulos/Bennett Thrasher

Peter Stathopoulos is a Partner and leads Bennett Thrasher’s State and Local Tax practice. Peter has been practicing in the area of state and local taxation and economic development incentives since 1993. Peter has extensive experience in helping clients reduce their effective state tax rates through multi-state tax planning and in resolving state tax controversies from the audit level through litigation in state trial and appellate courts.

Prior to joining the firm, Peter was a partner with a national law firm and practiced in the area of state and local tax controversy and litigation. Prior to entering private law practice, Peter was a principal consultant in the multi-state tax consulting practice of a Big Four accounting firm. Prior to joining Big Four accounting, Peter was a tax policy attorney with the Georgia Department of Revenue.

Peter has worked closely with state tax and economic development policy makers to represent the business community’s interests. In 2008, Peter helped draft a portion of the Georgia Entertainment Industry Investment Act as well as legislation that expanded a variety of Georgia tax credits to apply to the broadcasting industry. In 2002, he co-chaired a joint Georgia Department of Revenue/State Bar of Georgia committee that help draft Georgia’s current consolidated income tax return regulations. In 2001, he served on the executive committee of the Business Council of Alabama that helped draft Alabama’s privilege tax scheme. In 1995, he was a tax policy attorney with the Georgia Department of Revenue and led the drafting of regulations for many of Georgia’s current tax credits and acted as a liaison with the Governor’s Economic Development Council.

I recently hosted Susanne Baugh, of Q&A Events on Midtown Business Radio.  As we got to talking, she mentioned that I should meet Emma Foulkes, Presidnt of the Atlanta Gay Lesbian Chamber of Commerce.  Because the respective missions of the chambers of commerce and Business Radio X have such overlap in the business environments we serve, I was pleased to reach out to her.

On this week’s episode I sat down with Alan Conner, of Your Professional CFO.  Alan is a tax and accounting expert who works with a wide range of companies and professionals, including physicians.

I met Alan a few weeks ago in the hall of our office building.  After learning about how he helps physicians, I knew we needed to have him stop by to talk about it.  In addition to providing basic accounting/payroll functions, Alan also helps physicians develop effective, legal tax strategies, including self funded insurance plans to reduce their tax burden and risk at the same time.

Alan shared the story of his older brother, an ER physician in Florida.  He explained the fact that his brother, as do many physicians, work as 1099 contractors for the respective practice they serve.  In this relationship, the doctor receives a gross paycheck with no tax withheld.

In this situation it is vital for the provider to plan for their tax obligation and pay it in a timely fashion (at least quarterly) or they face between 5-10% penalties, which can quickly add up to significant amounts, based on the numbers they’re working with.

Alan explained several options available to physicians that work as 1099 contractors, including self funded insurance plans, pension plans, SEP IRA’s, and others, that will help them preserve their hard-earned revenue for later while protecting them from risk such as loss of medical license should that occur.

It’s clear after speaking with him that it is advisable for our colleagues in the community to partner with experts such as Alan to develop a solid plan for managing their tax obligations as well as helping to secure their financial future.

This week we heard from experts in corporate law (workers compensation and mergers & acquisitions), web design and customer experience, and corporate executive compensation and financial planning.  I hosted folks from Nine Labs, Polygon, Casey Gilson, Nelson Mullins, and SoundRiver Advisors.

J. Cornelius is the President of Nine Labs, a web design and customer experience company based in Atlanta.  He also started Polygon, an event space designed and dedicated to support Atlanta’s growing technology industry.  Nine Labs is a user experience consultancy that helps businesses improve the look and feel of their digital technologies, making sure that a customer’s experience is useful, intuitive, and branding is maintained across the variety of digital media, mobile devices, and other user interfaces.  The company will provide message content or work with their client’s internal team to optimize the way the client presents their brand to the public.  Nine Labs is able to help businesses that are putting effort into making sure their customers can have a consistent experience across all digital/mobile platforms.  They often encounter situations where a user’s experience on a mobile device is very different in terms of look and feel of a company’s branding, along with less-than-optimal navigation or functionality.  Nine Labs’ experts are able to bring a consistent, positive experience to a company’s web visitors, regardless of technology used to access it.  Polygon is an event space located in popular Atlantic Station in Midtown Atlanta that was created to provide  technology companies and associations with a place to have productive networking, planning, and educational events.  The space is located, laid out, and equipped with the Atlanta technology industry in mind.

Rayford Taylor is an attorney with the firm, Casey Gilson PC, admitted to practice law in Florida and Georgia. The majority of his practice is providing advice and representation to employers, insurance companies, insurance funds, and third party administrators in the defense of workers’ compensation claims, whether at trial or on appeal.  Rayford also represents such entities in disputes with both Florida and Georgia state governments and regulators involving the operation of their companies and businesses. Michael Hollingsworth is an award-winning attorney with Nelson, Mullins, Riley, and Scarborough LLP, located in Atlanta.  He is a managing partner of Nelson Mullins Riley & Scarborough’s Atlanta office, and is co-head of the Firm’s Mergers & Acquisitions Group. Mr. Hollingsworth focuses on middle-market corporate transactions, including mergers, acquisitions, divestitures, and joint ventures. The healthcare environment changes daily and physicians often struggle to keep up with regulatory changes, competition and reimbursement changes. There are many challenges looming: Obamacare, ICD-10 and Meaningful Use. Providers must spend time working on their practices as well as in their Atlanta Business Radio practices to thrive and not just survive. However, practices do not have to stay in a reactive mode. Taking time to plan can put a practice in a proactive mode to be able to anticipate and appropriate respond to opportunities, changes and challenges.

Quarter 4 is the perfect time to take action to minimize tax burden, maximize retirement plans, reconcile inventory, create the coming year’s budget and evaluate the coming year’s capital needs. Taking inventory, updating depreciation schedules, retirement planning, fee schedule analysis, A/R cleanup, tax planning, productivity and compensation evaluation are just some of the year end financial activities that can really make a difference in achieving solid financial performance.

Planning for retention of market share and growth is key to future practice viability yet how many practices have a formal, annual marketing plan. Marketing is often viewed as an expense vs. an investment yet new patients are a critical piece of revenue generation for every practice. The same marketing plans often do not yield different results and how providers reach, communicate with and message to current and potential patients is changing. Year end is a great time to acknowledge referral sources and examine the ROI of existing marketing efforts, brand cohesiveness, content relevancy and process, social media effectiveness and to make adjustments as needed. In a recent poll, 51% of patients said that digital communications would make them feel more valued as a patient and 41% said social media would affect their choice of healthcare providers. Is your practice keeping up with the interactive“new word of mouth” ?

An overall strategic plan can be the differentiating for success. Yet, many providers either don’t know how or feel they don’t need it. Yet, evaluation of Key Performance Indicators (KPI’s) to show the current standing of a practice, a SWOT analysis, a competitive overview and then making and implementing a strategic plan will help all businesses be positioned to recognize and capitalize on growth opportunities, assist in overcoming challenges and help protect market share for any business.
