Nelson Mullins and City of Atlanta Department of Procurement

We talked about important business considerations regarding ACA requirements this year, along with the opportunities to do business with the City of Atlanta through the Department of Procurement.  I was joined in the studio by Ann Murray, attorney with Nelson, Mullins, Riley, and Scarborough, and Chief Procurement Officer for the City of Atlanta, Adam Smith.

The ACA business mandates have begun to be implemented on larger scales over the past two years.  As we know, some of the requirements have been pushed back a couple of times, delaying their impact.  But those times are behind us and business owners need to be spending time with legal experts such as those at Nelson Mullins, to assess what their obligations will be regarding providing health insurance benefits to some or all of their employees.

Ann explained the basics of some of these requirements around health benefits for the small business.  She also discussed new reporting requirements that business owners must compile from multiple sources to be in full compliance with the law.

Murray talked about the fact that many business operators mistakenly think they’re exempt from the law’s requirements, failing to see that being a small unit that is part of a larger whole, as in the case of some multi-site businesses, potentially exposes them to have to offer benefits.  Failure to comply can result in significant financial penalties that could literally threaten the business’s viability.

Atlanta’s Chief Procurement Officer, Adam Smith stopped by to share information about the upcoming Business Expo at the Georgia World Congress Center March 31st.  This free-to-the-public event will feature a wealth of information about the numerous needs the city has for a wide variety of goods and services to operate the city’s 15 departments, including the Atlanta airport.

The expo will have sessions where small business owners can learn what is required to be able to bid on these opportunities, as well as how to fully complete the necessary documents contained in a bid to have their bid received and considered.

Adam explained that the city’s needs range from culinary services at the airport, to commodity supplies such as paper, pens, cleaning supplies, etc.  Additionally, the city is looking for engineering services, cleaning services, construction, and numerous others as well.

Smith also talked about certifications available to disadvantaged business enterprises that once obtained, provides these businesses with access to opportunities ear-marked for diversity suppliers.  He went on to distinguish these certifications businesses may obtain from county or state governments, as well as other certification bodies such as GMSDC.

Health Care Fraud and False Claims

I hosted 2 False Claims Act legal experts on this week’s MAG edition of Top Docs Radio.  You’re going to want to check out what they have to say, as it could mean the difference between practicing medicine or not, in the end.

Scott Grubman is a partner with the law firm of Chilivis Cochran Larkins & Bever in Atlanta. He represents health care providers of all types and sizes with government investigations and audits, False Claims Act, and other complex litigation and various regulatory and compliance matters.  Prior to joining private practice, Scott served as a trial attorney with the U.S. Department of Justice in Washington, D.C., and as an assistant U.S. attorney in Savannah – where he served on a district health care fraud taskforce.  Scott also serves as an adjunct professor at Georgia State University’s College of Law, where he teaches a course in health care fraud and abuse.

Jason Marcus is among a select group of lawyers who devote their practice to qui tam and related retaliation claims under federal and state False Claims Acts. He has practiced FCA law exclusively since 2008, and he formed the firm of Bracker & Marcus in January of 2015 with partner Julie Bracker, who is dedicated to representing whistleblowers nationwide. Jason is a 2006 graduate of the University of Georgia School of Law, a former clerk to the honorable Magistrate Judge G.R. Smith of the Southern District of Georgia, and a member of Taxpayers Against Fraud Education Fund and the Georgia affiliate of the National Employment Lawyers Association.

Health care is one of the fastest growing and most heavily-regulated industries in the United States.  Given that government payers (Medicare, Medicaid, etc.) finance a significant portion of the system, regulators and law enforcement have dedicated tremendous resources to rooting out and punishing fraud and abuse in health care.  In fiscal year 2015 alone, the federal government recovered nearly $2 billion in settlements and judgments from health care providers under the federal False Claims Act, which does not include recoveries through audits and other administrative avenues.

Moreover, not only are the actions of healthcare providers constantly scrutinized by federal and state auditors

and law enforcement, but also by competitors, commercial insurance companies, private whistle blowers, and the public. Big hospitals and health care entities with “deep pockets” have historically carried the bulk of the liability in government enforcement actions.  But beginning in 2015, the federal government announced a new policy which focuses on holding individuals – particularly individual health care providers – responsible and liable for unlawful conduct. A lot of the laws governing health care fraud and abuse do not require a specific intent to defraud or even actual knowledge of the unlawful nature of the conduct. In fact, one of the major laws governing health care fraud and abuse (the physician self-referral law or “Stark law”) requires no culpable mindset whatsoever.  Accordingly, it is crucial for health care professionals of all types to be aware of the various statutory and regulatory schemes that govern health care billing and to act accordingly.

This week I hosted Karen Weinstock, of Weinstock Immigration Lawyers and Adrian Queenan, founder and CEO of Expand a Brand.  Adrian and his team created the familiar tear-shaped banners you see at conferences, sporting events, and festivals.  Expand a Brand is a South African-based company that recently launched a US location.

Both Karen and Adrian immigrated to the states and launched businesses here.  Karen shared her personal story of the challenges she experienced when she was going through the process of working to get a visa, establish her credit, get an apartment, securing work, etc.  It was during this time she decided she would direct her work to helping immigrants who followed after her.

Adrian talked about how they had been doing business in the US for a number of years through a local distributor.  They ultimately decided they would create a US-base of operations to supplement their original location.  He described how he researched numerous immigration attorneys prior to applying for the necessary visa.

They chose the Weinstock Immigration Lawyers to give them guidance through the assistance and were successful in getting established in the US and have been growing their business since.  Adrian talked about how his company provides a variety of tents and banners for use at any sort of event.  And they provide a product that is designed to stand out visually to help their customers present their brands effectively in busy event venues.

Daphne Reiley is the founder of Ripples of Grace, a consulting practice meeting communities of faith in their mission to include the isolated.  Daphne has found that isolation takes many forms and that communities of faith, in particular, should be but are often not very good at meeting the needs of  isolated individuals and families.

Ripples of Grace provides education to organizations desiring to better address ways of reaching out to isolated populations. Daphne offers workshops to professional organizations as well as communities of faith.  She also facilitates retreats for pastors, congregational leaders, and groups of individuals.

Along with her favorite co-author Joseph LaGuardia, she is working on a companion book to their previously published “A Tapestry of Love, the Spirituality of Caregiving”.  The work in progress – “Taking It to Heart” –  is a book aimed at those receiving long-term care.

Victoria Collier is a Certified Elder Law Attorney through the National Elder Law Foundation. She is also the only Georgia attorney who has received the highest award by the National Academy of Elder Law Attorneys, Fellow of the Academy. More locally, Victoria was appointed by Gov. Sonny Perdue in 2010 to the Georgia Council on Aging, and still resides on the Council. Hank Halter is a highly accomplished accounting and finance professional, with 25 years of experience overseeing the finance and accounting operations at Fortune 500 companies. Since 2013, he has served as President and CEO of Delta Community Credit Union, one of Atlanta’s largest financial institutions and Georgia’s largest credit union with assets of $4.8 billion. He also serves on Delta Community’s Board of Directors, where he has been active since 2006.

Before joining Delta Community, Hank worked at Delta Air Lines from 1998 to 2012. He served in a number of finance positions there before being promoted to Chief Financial Officer in 2008. Prior to Delta, Hank worked at American Airlines and Ernst & Young.

In addition to serving on the Delta Community board, Hank is also on the Board of Advisors of Sojern and he chairs the Audit Committee for the board of Southern Air.

Hank is a Certified Public Accountant and holds a Bachelor of Science degree in Accountancy from Villanova University and a Master of Business Administration degree from Duke University. A frequent speaker at trade and academic conferences, Hank resides in Atlanta.
