Nelson Mullins and City of Atlanta Department of Procurement

We talked about important business considerations regarding ACA requirements this year, along with the opportunities to do business with the City of Atlanta through the Department of Procurement.  I was joined in the studio by Ann Murray, attorney with Nelson, Mullins, Riley, and Scarborough, and Chief Procurement Officer for the City of Atlanta, Adam Smith.

The ACA business mandates have begun to be implemented on larger scales over the past two years.  As we know, some of the requirements have been pushed back a couple of times, delaying their impact.  But those times are behind us and business owners need to be spending time with legal experts such as those at Nelson Mullins, to assess what their obligations will be regarding providing health insurance benefits to some or all of their employees.

Ann explained the basics of some of these requirements around health benefits for the small business.  She also discussed new reporting requirements that business owners must compile from multiple sources to be in full compliance with the law.

Murray talked about the fact that many business operators mistakenly think they’re exempt from the law’s requirements, failing to see that being a small unit that is part of a larger whole, as in the case of some multi-site businesses, potentially exposes them to have to offer benefits.  Failure to comply can result in significant financial penalties that could literally threaten the business’s viability.

Atlanta’s Chief Procurement Officer, Adam Smith stopped by to share information about the upcoming Business Expo at the Georgia World Congress Center March 31st.  This free-to-the-public event will feature a wealth of information about the numerous needs the city has for a wide variety of goods and services to operate the city’s 15 departments, including the Atlanta airport.

The expo will have sessions where small business owners can learn what is required to be able to bid on these opportunities, as well as how to fully complete the necessary documents contained in a bid to have their bid received and considered.

Adam explained that the city’s needs range from culinary services at the airport, to commodity supplies such as paper, pens, cleaning supplies, etc.  Additionally, the city is looking for engineering services, cleaning services, construction, and numerous others as well.

Smith also talked about certifications available to disadvantaged business enterprises that once obtained, provides these businesses with access to opportunities ear-marked for diversity suppliers.  He went on to distinguish these certifications businesses may obtain from county or state governments, as well as other certification bodies such as GMSDC.

A few weeks ago, I hosted Jannine Miller, Director, Center of Innovation for Logistics at the Georgia Department of Economic Development. We talked about what the state of Georgia is doing to facilitate an effective, innovative infrastructure to support logistics needs for regional businesses.

On this week’s show I sat down with friend of the show, Bo Wilkins, of Sound River Advisors and three logistics experts who represent workforce management, third party logistics (3PL), and the legal needs for the vertical.

Page Siplon is the CEO of Team One Logistics. He was actually Jannine Miller’s predecessor at the Georgia Department of Economic Development. Team One Logistics is a workforce management company that supplies an outsourced option for logistics companies that want to achieve greater profitability and reduced risk. One of the largest (if not the largest) costs for a business comes from their SG&A which includes employee-related expense such as salaries, taxes, and worker’s comp.

Team One Logistics takes over (or provides) and manages the workforce for logistics companies and logistics divisions within enterprises. By allowing Team One to “own” and provide the employees such as truck drivers, forklift operators, etc., their clients give up the exposure to risk that comes with worker’s compensation, health benefits, and other employee-related costs. These expenses are often one of the largest if not the largest costs for a company.

Because their focus is exclusively on the human component necessary to make a logistics operation work, Team One is able to take advantage of their large workforce to get good benefits rates for their workers. They’re also able to manage worker’s comp risks effectively through focused education and policies for their workers that reduce risk for accidents.

Vector Global Logistics is an asset free, third party logistics company /  NVOCC that provides exceptional sea freight, air freight, truck, rail, general logistic services and consulting for their clients. Their unique results-only culture brings a fresh and new approach to logistics.

Vector Global Logistics Managing Director, Enrique Alvarez, came on and talked about how they use a consultative approach with their customers to maximize efficiency and cost savings for their client companies. Rather than focusing on simply leasing out available cargo space, the company continually seeks to learn more about the businesses they serve in an effort to identify ways that transport routes and modes provide the fastest possible shipping for the lowest possible cost.

Enrique shared a story about a client for whom they were able to save $2 million annually by changing the primary route an international company was utilizing. They were able to save another major manufacturer millions by addressing the shipping option being used which meant inventory arrived as much as 2 weeks sooner than had been experienced previously.

Michael Golden is a partner with Arnall, Golden, & Gregory. They’re an Atlanta-based law firm that provides a variety of corporate legal expertise, one of which being logistics. Michael explained how important it is for the businesses operating within the logistics arena to have a relationship with a law firm with logistics experts on their team. He gave several examples of common missteps logistics companies make in their operations that can result in significant financial loss. One of those relates to companies listing what the law would consider “employees” as 1099 Independent Contractors.

We also talked about the impact that the Affordable Care Act will have on these companies as the employer mandate rolls into effect in the coming year. Without the right legal expert, these businesses can be exposed to major costs and penalties if they don’t handle their approach to employee benefits requirements correctly.

This week we heard from experts in corporate law (workers compensation and mergers & acquisitions), web design and customer experience, and corporate executive compensation and financial planning.  I hosted folks from Nine Labs, Polygon, Casey Gilson, Nelson Mullins, and SoundRiver Advisors.

J. Cornelius is the President of Nine Labs, a web design and customer experience company based in Atlanta.  He also started Polygon, an event space designed and dedicated to support Atlanta’s growing technology industry.  Nine Labs is a user experience consultancy that helps businesses improve the look and feel of their digital technologies, making sure that a customer’s experience is useful, intuitive, and branding is maintained across the variety of digital media, mobile devices, and other user interfaces.  The company will provide message content or work with their client’s internal team to optimize the way the client presents their brand to the public.  Nine Labs is able to help businesses that are putting effort into making sure their customers can have a consistent experience across all digital/mobile platforms.  They often encounter situations where a user’s experience on a mobile device is very different in terms of look and feel of a company’s branding, along with less-than-optimal navigation or functionality.  Nine Labs’ experts are able to bring a consistent, positive experience to a company’s web visitors, regardless of technology used to access it.  Polygon is an event space located in popular Atlantic Station in Midtown Atlanta that was created to provide  technology companies and associations with a place to have productive networking, planning, and educational events.  The space is located, laid out, and equipped with the Atlanta technology industry in mind.

Rayford Taylor is an attorney with the firm, Casey Gilson PC, admitted to practice law in Florida and Georgia. The majority of his practice is providing advice and representation to employers, insurance companies, insurance funds, and third party administrators in the defense of workers’ compensation claims, whether at trial or on appeal.  Rayford also represents such entities in disputes with both Florida and Georgia state governments and regulators involving the operation of their companies and businesses. Michael Hollingsworth is an award-winning attorney with Nelson, Mullins, Riley, and Scarborough LLP, located in Atlanta.  He is a managing partner of Nelson Mullins Riley & Scarborough’s Atlanta office, and is co-head of the Firm’s Mergers & Acquisitions Group. Mr. Hollingsworth focuses on middle-market corporate transactions, including mergers, acquisitions, divestitures, and joint ventures. He also serves on the Firm’s Executive Committee, the governing body of seven partners who oversee firm standing committees, strategic initiatives, and firm operations.
